Summary
(1) The Order of the People's Government of the People's Republic of China No. 803, Implementing the Regulations on the Implementation of the Law of the People's Republic of China on Counteracting Unjustified Measures of Foreign States, was passed at the 55th meeting of the State Council on March 21, 2025, and is hereby promulgated and shall come into effect as of the date of its promulgation.
(2) Article 1: These Regulations are formulated in accordance with the Law of the People's Republic of China on Diplomatic Relations, the Law of the People's Republic of China on Counteracting Unjustified Measures of Foreign States, and other relevant laws.
(3) Article 2: The counteracting unjustified measures of foreign states work shall be carried out in accordance with the overall national security concept, protecting the country's sovereignty, security, and development interests, and safeguarding the legitimate rights and interests of Chinese citizens and organizations.
(4) Article 3: Where a foreign state, organization, or individual violates international law and basic norms governing international relations, takes discriminatory restrictive measures against Chinese citizens or organizations, or interferes in China's internal affairs, or a foreign state, organization, or individual implements, assists, or supports activities that harm China's sovereignty, security, and development interests, the relevant departments of the State Council shall, in accordance with the Law of the People's Republic of China on Counteracting Unjustified Measures of Foreign States and these Regulations, have the right to decide to place the relevant organizations or individuals on the list of countermeasures, take countermeasures, and impose restrictions on their activities.
(5) Article 4: The relevant departments of the State Council shall have the right to conduct investigations and hold external consultations in the course of implementing the Law of the People's Republic of China on Counteracting Unjustified Measures of Foreign States and these Regulations.
(6) Article 5: When the relevant departments of the State Council make a decision to take countermeasures, they shall clearly specify the objects of the countermeasures, the specific countermeasures, the date of implementation, etc.
(7) Article 6: The implementation of the measures specified in Article 6, paragraph 1 of the Law of the People's Republic of China on Counteracting Unjustified Measures of Foreign States, such as refusal to issue visas, refusal to enter, revocation of visas, or deportation, shall be handled by the relevant departments of the Ministry of Foreign Affairs and the National Immigration Administration.
(8) Article 7: The implementation of the measures specified in Article 6, paragraph 2 of the Law of the People's Republic of China on Counteracting Unjustified Measures of Foreign States, such as seizure, detention, or freezing, shall be handled by the relevant departments of the public security, finance, natural resources, transportation, customs, market supervision, financial management, intellectual property, etc.
(9) Article 8: The implementation of the measures specified in Article 6, paragraph 3 of the Law of the People's Republic of China on Counteracting Unjustified Measures of Foreign States, such as prohibition or restriction on Chinese citizens or organizations engaging in relevant activities, including education, science and technology, legal services, environmental protection, trade, culture, tourism, health, and sports, shall be handled by the relevant departments of the Ministry of Education, the Ministry of Science and Technology, the Ministry of Justice, the Ministry of Ecological Environment, the Ministry of Commerce, the Ministry of Culture and Tourism, the National Health Commission, and the State Sports General Administration.
(10) Article 9: The implementation of other necessary measures specified in Article 6, paragraph 4 of the Law of the People's Republic of China on Counteracting Unjustified Measures of Foreign States, such as prohibition or restriction on engaging in relevant import and export activities, prohibition or restriction on investment in China, prohibition on exporting relevant goods, prohibition or restriction on providing data and personal information, cancellation or restriction on the work permit, residence permit, or stay permit of relevant personnel, and fines, shall be handled by the relevant departments.
(11) Article 10: The relevant departments of the State Council shall, in accordance with their respective duties and tasks, be responsible for coordinating and handling the work of the mechanism for coordinating countermeasures. The relevant departments of the State Council shall strengthen coordination and information sharing in the determination and implementation of countermeasures.
(12) Article 11: When the relevant departments of the State Council make a decision to take, suspend, change, or cancel countermeasures, they shall publish and update the decision on their official website and other channels.
(13) Article 12: When countermeasures need to be implemented by other departments of the State Council, the relevant departments that make the decision to take, suspend, change, or cancel countermeasures shall, in accordance with the relevant procedures, report the decision to the relevant departments that are responsible for implementing the countermeasures. The departments that receive the decision shall implement it in accordance with their duties.
(14) Article 13: The relevant departments of the State Council shall have the right to order correction, prohibit or restrict the organization or individual from engaging in government procurement, bidding, and other relevant activities, prohibit or restrict them from receiving or providing data and personal information from or to foreign countries, and prohibit or restrict their exit, stay, and residence in China, etc., if they fail to implement countermeasures in accordance with the law.
(15) Article 14: After the decision to take countermeasures is publicized, the organizations or individuals that are subject to the countermeasures may apply to the relevant departments of the State Council for suspension, change, or cancellation of the countermeasures, providing facts and reasons for their improvement behavior, measures to eliminate the consequences of their behavior, etc.
(16) Article 15: The relevant departments of the State Council that make decisions to take countermeasures may, in accordance with the actual situation, organize an assessment of the implementation and effectiveness of the countermeasures. Based on the assessment results or the examination of the facts and reasons provided by the organizations or individuals that are subject to the countermeasures, the relevant departments may suspend, change, or cancel the countermeasures.
(17) Article 16: After the decision to take countermeasures is publicized, if an organization or individual needs to engage in relevant activities with the organizations or individuals that are subject to the countermeasures in special circumstances, they shall provide relevant facts and reasons to the relevant departments of the State Council, and may be allowed to engage in the activities after being approved.
(18) Article 17: If a foreign state, organization, or individual executes or assists in the execution of discriminatory restrictive measures against Chinese citizens or organizations, the relevant departments of the State Council shall have the right to conduct talks, order correction, and take relevant measures.
(19) Article 18: If any organization or individual executes or assists in the execution of discriminatory restrictive measures against Chinese citizens or organizations, infringing on their legitimate rights and interests, Chinese citizens or organizations have the right to bring a lawsuit to the people's court, demanding a stop to the infringement and compensation for losses.
(20) Article 19: If a foreign state, organization, or individual, through promotion, implementation, or other means, harms China's sovereignty, security, and development interests, the relevant departments of the State Council shall have the right to decide to place the relevant organizations or individuals on the list of countermeasures
