(4)  一、《福建省农业机械管理条例》的修改内容

(5)  《福建省农业机械管理条例》(以下简称《条例》)自1999年6月1日起施行,经两次修订,为维护农业机械所有者、经营者、使用者的合法权益,加强我省农业机械管理发挥了重要作用。国务院《农业机械安全监督管理条例》第二十一条明确规定:“拖拉机、联合收割机投入使用前,其所有人应当按照国务院农业机械化主管部门的规定,持本人身份证明和机具来源证明,向所在地县级人民政府农业机械化主管部门申请登记。拖拉机、联合收割机经安全检验合格的,农业机械化主管部门应当在2个工作日内予以登记并核发相应的证书和牌照”,仅对拖拉机和联合收割机进行牌证管理。我省《条例》规定实行牌证管理的农业机械范围与上位法规定不一致,明显滞后不适合继续适用。因此,对我省《条例》第十四条进行相应修改,即将第十四条第一款修改为:“农业机械管理部门对拖拉机和联合收割机实行牌证管理”,并删除第二款。

(6)  二、《福建省道路运输条例》的修改内容

(7)  《福建省道路运输条例》(以下简称《条例》)自2014年1月1日起施行,为维护我省道路运输市场秩序,保障道路运输安全,保护道路运输有关各方当事人的合法权益,推进道路运输业的健康发展发挥了重要作用。近年来,由于《中华人民共和国道路运输条例》的多次修改,《条例》的部分条款与上位法存在不一致且明显滞后不适合继续适用的情形,如道路货物运输站(场)经营、机动车维修经营、机动车驾驶员培训、小微型客车租赁经营等领域的市场准入条件已由许可改为备案。为进一步优化我省营商环境,更好地融入全国统一大市场,亟需对《条例》中9个条款进行修改,修改后原体例框架不变,合计七章、共七十八条。

(8)  (一)《中华人民共和国道路运输条例》第三十九条,已将从事道路货物运输站(场)经营、机动车维修经营、机动车驾驶员培训等领域的市场准入由许可改为备案,为此,将《条例》第三十五条、第四十四条中道路货物运输站(场)经营、机动车维修经营、机动车驾驶员培训、机动车驾驶员培训机构的准入由许可改为备案,相应删去第四十四条第二款。

(9)  (二)《国务院关于第二批取消152项中央指定地方实施行政审批事项的决定》(国发〔2016〕9号),取消“机动车驾驶培训教练员从业资格认定”的要求,因此,删去第四十四条第八项教练员的聘用条件中“不得聘用未取得《教练员证》的人员从事培训活动”的要求。

(10)  (三)为进一步优化营商环境,对照《小微型客车租赁经营服务管理办法》相关规定,将《条例》中从事小微型客车租赁经营的管理由许可改为备案(第三十五条)。因此,删去第四十六条第二款汽车租赁经营许可条件和程序要求;删去第四十八条、第四十九条中关于《租赁汽车证》的相关规定;相应删去第七十条、第七十一条中违反许可的法律责任规定。

(11)  (四)关于法律责任部分。一是为解决因社会情况变化带来的行政执法实践中遇到的法律适用选择难题,更好地打击违法行为,增加一条“违反本条例规定的行为,法律、行政法规对法律责任已有规定的,从其规定。”(第六十五条);二是鉴于《条例》第六十九条列举的违法情形在《中华人民共和国道路运输条例》及交通运输部规章中都有相应的法律责任规定,可直接适用,不会造成管理真空,因此删去第六十九条。
