Summary

In recent years, agricultural product quality safety has been a hot issue raised by the people's representatives and members of the Provincial Committee for Consultation, and many representatives and members have suggested speeding up local legislation. In 2017, the Standing Committee of the Provincial People's Congress conducted an inspection and inquiry on the enforcement of the "Agricultural Product Quality Safety Law of the People's Republic of China", and emphasized the need to accelerate local legislation and issue local regulations to match the above-level law as soon as possible. In recent years, our province has consistently implemented the requirements of Xi Jinping's "most stringent standards, most strict supervision, most severe punishment, and most serious accountability" and has made solid progress in agricultural product quality safety supervision, which has effectively promoted the stable and good development of agricultural product quality safety in the province. At the same time, our province still faces difficulties and challenges in agricultural product quality safety work, mainly including: pesticide and veterinary drug residues exceeding standards, frequent prohibition of prohibited substances, weak administrative penalties, low costs of violation, weak grassroots supervision capabilities, and difficulty in implementing "the last mile" of supervision. Therefore, it is urgently necessary to draft the Ordinance to further regulate the above-mentioned situations on the institutional level and to continuously improve the level of agricultural product quality safety in our province.

(6)  The "Ordinance (Draft)" adopts a chapter-based structure, consisting of 7 chapters and 49 articles, including General Provisions, Agricultural Product Origin, Agricultural Product Production, Agricultural Product Sales, Supervision and Management, Legal Liability, and Appendices. The main contents are as follows:

(4)  一、关于制定条例的必要性

(5)  一是贯彻落实党中央、国务院决策部署和省委、省政府工作要求。农产品质量安全事关人民群众身体健康和生命安全,是重大的民生工程、民心工程。党的十九大提出,实施食品安全战略,让人民吃得放心。党的二十大报告从推进国家安全体系和能力现代化的高度对食品安全工作作出部署,要求强化食品安全监管。省委、省政府印发《福建省深化改革加强食品安全工作行动方案》,对加强农产品质量安全监管提出具体工作要求。因此,制定条例是贯彻党中央、国务院决策部署和省委、省政府工作要求的重要举措。

(6)  二是加强我省农产品质量安全监管的法治保障。《中华人民共和国农产品质量安全法》于2006年公布施行。十多年来,我省深入贯彻落实《中华人民共和国农产品质量安全法》,但尚未配套出台地方性法规。近年来,农产品质量安全一直是我省人大代表、政协委员关注的热点问题,不少代表、委员都提出了加快我省地方立法的建议。2017年,省人大常委会开展《中华人民共和国农产品质量安全法》执法检查和专题询问,明确要求加快地方立法步伐,尽快出台与上位法配套的地方性法规。因此,有必要制定条例,对《中华人民共和国农产品质量安全法》进行细化和补充,着力筑牢全过程全链条守护人民群众“舌尖上的安全”的法治防线。

(7)  三是进一步提升我省农产品质量安全水平的现实需要。近年来,我省坚定不移贯彻落实习近平总书记提出的“最严谨的标准、最严格的监管、最严厉的处罚、最严肃的问责”要求,扎实推进农产品质量安全监管,有力促进全省农产品质量安全形势稳定向好。与此同时,我省农产品质量安全工作仍然面临困难和挑战,主要是:农药兽药残留超标时有发生,禁用物质屡禁不止;行政处罚力度偏弱,违法成本偏低;基层监管能力薄弱,监管“最后一公里”难以落实等。因此,亟需通过制定条例,对上述情形在制度层面予以进一步规范,持续提升我省农产品质量安全水平。

(8)  二、关于《条例(草案)》几个主要问题的说明

(9)  《条例(草案)》采用章节式结构,包括总则、农产品产地、农产品生产、农产品销售、监督管理、法律责任和附则,共7章49条。具体情况如下:

(10)  一是关于主体责任的问题。为压实各方主体责任,形成合力共同保障我省农产品质量安全,《条例(草案)》从以下三个方面作出规定:一是明确政府责任,县级以上政府统一领导、组织、协调本行政区域的农产品质量安全工作,建立健全农产品质量安全工作机制和网格化监督管理体系;乡镇人民政府、街道办事处落实农产品质量安全监督管理责任,配合有关部门做好监督管理工作(第三条、第四条)。二是明确部门责任,对农业农村、海洋渔业、林业、卫健、粮储、市场监管等部门应履行的农产品质量安全工作职责分别作出规定(第五条)。三是明确农产品生产经营者责任,要求对其生产经营的农产品质量安全负责,依照法律、法规和农产品质量安全标准从事生产经营活动,并接受社会监督(第六条)。

(11)  二是关于农产品产地的问题。良好产地环境是保障农产品质量安全的基础条件。为强化农产品产地安全管理,《条例(草案)》从以下四个方面作出规定:一是农业农村、海洋渔业、林业部门会同生态环境、自然资源等部门定期开展农产品产地安全调查、监测和评价工作,提出划定特定农产品禁止生产区域的建议,并对特定农产品禁止生产区域的具体要求作出规定(第十条、第十一条)。二是县级以上政府推进绿色食品原料以及农业标准化生产基地和无规定动物疫病区的建设;鼓励社会力量对农产品生产基地进行资金和技术投入(第十二条)。三是要求农业投入品的生产者、经营者、使用者按规定回收并妥善处置包装物和废弃物;县级以上政府根据本地实际,组织建立布局合理的废弃物回收网络,并按规定进行资源化、无害化处理(第十三条)。四是明确农产品产地污染责任人在农产品产地污染风险方面的管控和修复义务(第十四条)。

(12)  三是关于农产品生产的问题。为把好农产品生产安全关,从源头上确保农产品质量安全,《条例(草案)》从以下三个方面作出规定:一是农业农村、海洋渔业、林业部门制定保障农产品质量安全的生产技术要求和操作规程,并加强宣传、培训、指导、推广;农产品生产企业、农民专业合作社等主体按照农产品生产技术要求和操作规程规范生产、服务(第十六条、第十七条)。二是要求农产品生产企业、农民专业合作社等主体做好农产品生产记录,农业投入品的经营者建立销售台账(第十八条、第十九条)。三是对农业投入品使用、绿色优质农产品培育等内容作出规定(第二十条至第二十二条)。

(13)  四是关于农产品销售的问题。为进一步规范农产品销售环节,让老百姓吃得安全吃得放心,《条例(草案)》从以下四个方面作出规定:一是对农产品的包装、保鲜、储存、运输、冷链物流等予以规范(第二十三条、第二十四条)。二是明确我省实行食用农产品承诺达标合格证与一品一码食品安全信息追溯并行制度,对开具承诺达标合格证、生成追溯凭证的主体、情形、具体要求等分别作出规定(第二十五条至第二十八条)。三是对承诺达标合格证、追溯凭证的展示、查验、留存等作出规定(第二十九条、第三十条)。四是参照食品召回的制度设计,对食用农产品召回作出规定,在生产、经营环节中发现食用农产品不符合食品安全标准或可能危害人体健康时,立即停止生产、经营并予以召回(第三十一条)。

(14)  五是关于监督管理的问题。为落实习近平总书记提出的“四个最严”要求,提升我省农产品质量安全水平,《条例(草案)》从以下五个方面作出规定:一是县级以上政府加强农产品质量安全监督管理、检验检测和执法能力建设(第三十二条)。二是明确农业农村、海洋渔业、林业、市场监管部门建立食用农产品承诺达标合格证、追溯凭证问题通报协查机制(第三十三条)。三是明确农业农村、海洋渔业等部门对农产品质量安全进行监督管理,根据情况定期或随机开展风险监测和监督抽查,并加强对农产品质量安全检测机构的监督管理(第三十四条至第三十六条)。四是对农产品生产经营者申请复检及协助、配合农产品质量安全监督检查等情形作出规定(第三十七条至第三十九条)。五是对可能误导消费者和社会舆论的农产品质量安全信息的核查以及举报处理予以明确(第四十条、第四十一条)。
