Summary

(1)　 In 2024, under the correct leadership of the Party Central Committee, the State Council, and provincial committees, and under the supervision and guidance of the provincial people's congress and its standing committee, all levels of government in the province adhered to the guidance of Xi Jinping's thoughts on socialism with Chinese characteristics in the new era, deeply implemented Xi Jinping's thoughts on the rule of law, comprehensively implemented the spirits of the 20th National Congress of the Communist Party of China and the second and third plenary sessions of the 20th Central Committee, and made breakthroughs in the target requirements for building a rule of law government. The province's rule of law government construction achieved new results. The following is a report on the situation.

(2)　 I. Strengthening organizational leadership and implementing the decisions of the Party Central Committee and the State Council.

(3)　 1. Deeply studying and implementing Xi Jinping's thoughts on the rule of law. Xi Jinping's thoughts on the rule of law were included in the learning content of the provincial government's regular meetings, leading provincial government cadres to deeply learn and implement them. A rule of law government construction training session was held, with 106,000 leaders and cadres at the provincial, municipal, county, and township levels participating synchronously.

(4)　 2. Seriously performing the responsibilities of the first responsible person for rule of law government construction. The main responsible person of the provincial government held several meetings of the provincial government's regular meeting to study legislation and law enforcement, and presided over the third joint meeting of the provincial government and the provincial court, pushing forward the solution to the outstanding problems in rule of law government construction.

(5)　 3. Perfecting the mechanism for promoting rule of law government construction. The "Henan Province 2024 Rule of Law Government Construction Work Arrangement" was issued, and rule of law government construction work was included in the 2024 provincial level inspection and examination plan. The situation of the main responsible person of the Party committee and the government performing the responsibility of the first responsible person for rule of law construction was included in the key points of the provincial committee's inspection, urging the promotion of all tasks.

(6)　 II. Perfecting the government's institutional function system, and better playing the role of government.

(7)　 1. Promoting the optimization and coordination of government institutional functions. The personnel configuration of grassroots personnel was optimized, with over 10,000 personnel being transferred to the streets, increasing the average number of personnel per street from 72 to 87. The construction of the responsibility list system was strengthened, and the list of tasks for township (street) officials was established in an orderly manner.

(8)　 2. Improving the efficiency of government services. The "One-Stop Service" reform was promoted, with 17 national-level "One-Stop Service" items being put into operation, benefiting 207 million times of business and public services, with 5 items such as the "One-Stop Service for Newborns" being promoted nationwide.

(9)　 3. Optimizing the rule of law business environment. The "Henan Province Complaint and Report Handling Measures" was issued, and the "one center, one platform, one mechanism" (Provincial Complaint and Report Center, Complaint and Report Platform, and Complaint and Report Closed-Loop Mechanism) working framework was established. Measures to support individual industrial and commercial households and small and micro enterprises were issued, stimulating the vitality of business entities. Mechanisms for intellectual property administrative mediation, patent disputes, and other matters were established, with 5433 cases being mediated and resolved.

(10)　 III. Perfecting the rule of law administrative system, and accelerating the promotion of government governance, standardization, and legalization.

Strengthening legislation in key areas. 8 local regulations, including the "Henan Province Patent Promotion and Protection Ordinance", were submitted to the Standing Committee of the Provincial People's Congress for review, and 6 provincial government regulations, including the "Henan Province Science and Technology Award Rules" (Provincial Government Decree No. 230), were issued.

(12)　 2. Actively promoting democratic legislation. The government's legislative liaison point "People's Will Direct Bus" played a full role, and the opinions of the masses were widely solicited through consultations and written submissions.

(13)　 3. Strengthening the formulation, supervision, and management of administrative normative documents. The "Henan Province Administrative Normative Documents Management Rules" (Provincial Government Decree No. 226) was comprehensively revised, further standardizing the formulation, filing, and examination procedures for administrative normative documents. A total of 2881 files were accepted for filing by provincial, municipal, and county governments, with 44 files being corrected for violating the law.

(1)　 2024年，在党中央、国务院及省委的正确领导下，在省人大及其常委会的监督指导下，全省各级政府坚持以习近平新时代中国特色社会主义思想为指导，深入践行习近平法治思想，全面贯彻党的二十大和二十届二中、三中全会精神，锚定法治政府建设率先突破目标要求，扎实推进依法行政，高质高效完成各项工作任务，法治政府建设取得新成效。现将有关情况报告如下。 一、加强组织领导，认真落实党中央、国务院决策部署。一是深学笃行习近平法治思想。将习近平法治思想列入省政府常务会议学习内容，引领全省政府机关干部深入学习践行。举办法治政府建设专题培训，省、市、县、乡四级1.06万名领导干部同步参训。二是切实履行法治政府建设第一责任人职责。省政府主要负责人多次召开省政府常务会议研究立法、执法等工作，主持召开省政府省法院第三次联席会议，推动解决法治政府建设中的突出问题。三是完善法治政府建设推进机制。印发《河南省2024年度法治政府建设工作安排》，将法治政府建设工作纳入2024年省级督查检查考核计划，将党政主要负责人履行法治建设第一责任人职责情况纳入省委巡视重点内容，督促推动各项任务落地见效。 二、健全政府机构职能体系，更好发挥政府作用。一是推进政府机构职能优化协同高效。优化基层人员编制配置，调剂1万余名编制下沉街道，街道平均编制由72名增至87名。加强权责清单制度建设，有序建立乡镇（街道）履职事项清单。二是提升政务服务效能。推进“高效办成一件事”改革，上线运行17项国家部署的“一件事”事项，惠及企业群众办事2.07亿件（次），新生儿出生“一件事”等5项做法在全国推广。三是优化法治化营商环境。印发《河南省营商环境投诉举报案件调查处理办法》，健全“一中心、一平台、一机制”（省营商环境投诉举报中心、营商环境投诉举报平台、投诉举报闭环解决机制）工作架构。出台支持个体工商户和小微企业发展若干措施，激发经营主体活力。健全知识产权行政调解告知引导、专利纠纷处理等机制，累计调处纠纷5433起。 三、健全依法行政制度体系，加快推进政府治理规范化、程序化、法治化。一是加强重点领域立法。提请省人大常委会审议《河南省专利促进和保护条例》等8部地方性法规，出台《河南省科学技术奖励办法》（省政府令第230号）等6件省政府规章。二是积极推进民主立法。充分发挥政府立法联系点“民意直通车”作用，采取座谈、书面征求意见等方式广泛吸纳民意、汇聚民智。三是加强行政规范性文件制定、监督和管理。全面修订《河南省行政规范性文件管理办法》（省政府令第226号），进一步规范行政规范性文件制定、备案审查等程序。省、市、县三级政府共受理报备文件2881件，纠正违法文件44件。 四、健全行政决策制度体系，提升行政决策公信力和执行力。一是持续完善行政决策制度。出台规范行政决策办法，将行政决策活动纳入法治化轨道。二是进一步规范重大行政决策。编制、公布省政府年度重大行政决策事项目录，建立全流程指导机制，督促各地、各部门严格履行重大行政决策法定程序。三是严格执行合法性审查程序。全面落实《河南省行政合法性审查工作规定》（省政府令第219号），实现对行政规范性文件、重大行政决策、行政协议及重大行政执法决定合法性审查全覆盖。 五、健全行政执法工作体系，推进严格规范公正文明执法。一是深化行政执法体制改革。分领域优化调整执法层级，指导市、县级执法队伍整合重塑。深化乡镇（街道）综合执法改革，制定乡镇（街道）行政处罚权指导目录，对赋权事项开展评估并动态调整。二是全面提升行政执法质效。完善以“双随机、一公开”监管为基本手段的监管机制，建立健全跨部门综合监管制度，全面推行包容审慎监管。持续推行行政执法“四张清单”制度和证明事项告知承诺制。不断加强食品药品、生态环境、安全生产等重点领域执法。完成全省19.7万名执法人员全员轮训，在全省推广使用执法规范化工作手册。进一步规范行政裁量权，实现常用行政处罚事项全覆盖。三是深入推行服务型行政执法。选择许昌市作为试点，探索建立证照到期前提醒工作机制，取得显著成效，2024年12月在全省全面推行。 六、健全突发事件应对体系，依法预防处置重大突发事件。一是完善突发事件应对制度。修订《河南省自然灾害救助应急预案》等3个省级专项应急预案，制定《河南省自然灾害风险形势会商研判工作规范》等6项制度，进一步完善会商研判、应急响应等工作机制。二是提高突发事件处置能力。加强省、市、县三级应急指挥部体系建设，建成“1+6+N”应急救援基地网络，组织开展8700场次应急救援练兵比武、30万人次参加。成功应对“24·7”暴雨灾害，守住不发生群死群伤事故底线。三是加强应急救援队伍建设。推进综合应急救援队伍、行业专业救援队伍和社会救援队伍标准化、规范化建设，构建多元化应急救援力量体系。 七、健全社会矛盾纠纷行政预防调处化解体系，不断促进社会和谐稳定。一是发挥行政复议化解行政争议主渠道作用。2024年全省共收到行政复议申请34777件，办结30460件，直接纠错率为17.86%；经调解、和解结案8223件，化解率为27%。二是加强行政应诉工作。聚焦行政争议实质性化解，持续推进行政机关负责人出庭应诉工作，全省行政机关负责人出庭应诉率达到92.36%。三是推进信访工作法治化。严格规范信访工作程序，强化信访问题源头治理。持续推动领导干部接访下访包案，接待群众6.4万批、14.1万人次，实现大量矛盾化解在基层。 八、健全行政权力制约和监督体系，促进行政权力规范透明运行。一是自觉接受监督。严格落实政府向人大及其常委会报告工作和接受问询制度。组织办理全国人大代表建议32件、政协提案5件，分办督办省人大代表建议1055件、政协提案1402件，代表、委员满意和基本满意率达到100%。二是强化行政执法监督。建成省、市、县、乡四级全覆盖的行政执法协调监督体系。创新常态化执法监督，林州市、镇平县试点工作成效显著。开展重点领域执法突出问题专项整治，着力解决以罚增收、以罚代管等问题。加大个案监督力度，推动个案监督向类案治理转变。三是全面主动落实政务公开要求。及时发布权威信息，通过省政府门户网站等平台发布省政府及办公厅文件404份，直播省政府新闻发布会74场次。持续加强政策解读，及时回应社会关切，省政府各部门共发布解读文稿2471篇。依法办理政府信息公开申请，2024年省政府办公厅受理申请755件。 九、健全科技保障体系，加快建设数字法治政府。一是加快推进信息化平台建设。建成上线省大数据平台，升级全省一体化政务服务平台、在线监管平台、协同办公平台等3个公共应用系统，创新打造“河南链”“豫事码”等场景应用支撑平台，初步形成“1+3+N”平台体系。二是加快推进政务数据有序共享。依托省大数据平台，完成国家、省、市三级数据直达基层工作，获取6个国家部委17项数据，接入61个省直单位644个信息系统数据源，累计归集政务数据1800亿条。三是深入推进“互联网+监管”。优化升级省“双随机、一公开”监管工作平台，支撑全省完成跨部门抽查1.53万次，抽取检查对象28.9万户。建立企业信用风险分类管理系统，促进监管更加精准高效。 2024年，我省法治政府建设虽然取得积极成效，但仍存在一些问题和短板，如基层政府依法行政能力还有待提高，行政执法不规范的现象仍时有发生，法治化营商环境与企业需求和群众期盼相比还存在差距等。2025年是“十四五”规划收官之年，我们将继续深入践行习近平法治思想，认真贯彻党中央、国务院关于法治政府建设的决策部署，聚焦“四高四争先”，全面提升政府依法行政能力和治理效能，为谱写中国式现代化河南篇章提供坚强支撑和有力保障。
