Summary

(1)　 The Chinese government has issued a notice regarding the export control of certain rare earth elements and their related materials. The export control applies to the following items: metallic neodymium (Nd), praseodymium (Pr), dysprosium (Dy), terbium (Tb), holmium (Ho), thulium (Tm), yttrium (Y), and scandium (Sc). The controlled items include metallic forms, alloys, targets, and compounds of these elements, as well as their oxides and mixtures.

(2)　 Specifically, the controlled items are:

(3)　 - Metallic neodymium (Nd) and its alloys, including Nd-Fe-B permanent magnets - Praseodymium (Pr) and its alloys, including Pr-Fe-B permanent magnets - Dysprosium (Dy) and its alloys, including Dy-Fe-B permanent magnets - Terbium (Tb) and its alloys, including Tb-Fe-B permanent magnets - Holmium (Ho) and its alloys - Thulium (Tm) and its alloys - Yttrium (Y) and its alloys - Scandium (Sc) and its alloys

(4)　 The export control also applies to the oxides and compounds of these elements, including their mixtures. The controlled items are used in various industries, such as electronics, renewable energy, and advanced ceramics.

(5)　 To implement the export control, exporters must apply for a license from the Ministry of Commerce and Customs General Administration. Exporters must also ensure accurate identification and declaration of the controlled items, including the two-use item export control code. Failure to comply with the regulations may result in customs detention and investigation.

(6)　 The export control measures are effective as of the date of publication and will be enforced by the Customs General Administration. The two-use item export control list will be updated accordingly. The Ministry of Commerce and Customs General Administration issued the notice on April 4, 2025.

(91)　 出口经营者出口上述物项应当依照《中华人民共和国出口管制法》《中华人民共和国两用物项出口管制条例》的相关规定向国务院商务主管部门申请许可。

(92)　 出口经营者应加强物项识别，报关时应在备注栏中注明是否属于管制物项，属于管制物项的应列明两用物项出口管制编码。对上述填报信息存有疑议的，海关将依法质疑，质疑期间出口货物不予放行。

(93)　 本公告自发布之日起正式实施。《中华人民共和国两用物项出口管制清单》同步予以更新。
