(1)  2023年,在党中央、国务院及省委的正确领导下,在省人大及其常委会的监督指导下,全省各级政府坚持以习近平新时代中国特色社会主义思想为指导,深入践行习近平法治思想,全面贯彻落实党的二十大和二十届二中全会精神,认真实施《法治政府建设实施纲要(2021—2025年)》,高质量完成法治政府建设各项任务,为经济社会发展提供了有力法治保障。现将有关情况报告如下: 一、加强组织领导,积极推动党中央、国务院决策部署落实。一是深入学习贯彻习近平法治思想。将习近平法治思想列入省政府常务会议学习内容,省政府以“坚定不移践行习近平法治思想,扎实推进依法行政、建设法治政府”为题开展法治专题理论学习。二是切实履行法治建设第一责任人职责。省政府主要负责人及时研究法治政府建设重大事项,带头落实科学决策、民主决策、依法决策制度,多次就法治政府建设提出明确要求。省政府主要负责人主持召开省政府省法院第二次联席会议,进一步深化府院联动工作,推动解决法治建设和司法实践中的突出问题。三是不断完善法治政府建设推进机制。将法治河南(法治政府)建设考核升级为全面依法治省考核,作为省管领导班子和领导干部年度综合考核内容的单独类目并加大分值比重,考核对象增加到126个。加大创建示范工作力度,推荐申报4个全国法治政府建设示范地区和5个示范项目,组织开展第三批全省法治政府建设创建示范活动,以创建促提升、以示范带发展,不断激发法治政府建设内生动力。 二、健全政府机构职能体系,推动更好发挥政府作用。一是推进政府机构职能优化协同高效。优化基层人员编制配置,从省、市、县三级调剂4.2万个编制下沉乡镇,乡镇平均编制数由69个增加到108个。二是深入推进“放管服”改革。持续深化行政审批制度改革,线上推进“一网通办”,线下推进审批业务系统进驻政务服务中心,并与省一体化政务服务平台联通。目前,省本级已有32个审批业务系统、1709项政务服务事项与省一体化政务服务平台实质性联通,全省95%以上的行政许可事项初步实现全程网办。三是加大监管力度。加快构建以信用为基础的新型监管机制,打通事前事中事后全监管环节,推动全省一体化信用监管系统全流程嵌入152个业务系统。编制更新全省统一的公共信用信息目录,归集信用信息突破140亿条。四是全面提升政务服务效能。印发政务服务“一件事一次办”改革实施方案,推动第一批45项全省企业和个人政务服务事项落地实施。五是持续优化营商环境。积极开展营商环境投诉举报和违法案件调查处理工作,形成“一中心、一平台、一机制”(省营商环境投诉举报中心、营商环境投诉举报平台、投诉举报闭环工作机制)工作架构。印发深化营商环境综合配套改革的意见及市场化、法治化、国际化3个专项改革方案,构建企业全生命周期权益保护机制。 三、健全依法行政制度体系,加快推进政府治理规范化、程序化、法治化。一是加强重点领域立法。省政府2023年度立法计划和重点立法项目均经省委常委会会议研究,提请省人大常委会审议《河南省标准化条例》等9部地方性法规,出台《河南省水路交通运输管理办法》(省政府令第220号)等7部省政府规章。二是积极推进民主立法。不断完善“1543”政府立法机制,拓宽社会各方有序参与政府立法的途径和方式,确定嵩山实验室等80个单位为省政府立法联系点。三是加强行政规范性文件制定监督管理。建立省直单位发文目录月抽查调阅制度。省政府备案审查行政规范性文件401件,审查并公布374件,纠正违法文件2件,不予备案25件。 四、健全行政决策制度体系,不断提升行政决策公信力和执行力。一是不断健全依法决策机制。公布年度省政府重大行政决策事项目录,推动决策事项严格履行法定程序。组织开展《河南省重大行政决策程序规定》实施效果评估,推进重大行政决策制度落实。二是严格落实合法性审查程序。出台《河南省行政合法性审查工作规定》(省政府令第219号),推进行政合法性审查工作制度化、规范化、标准化。对推动创新发展、改善营商环境等方面文件,从“合法性审查”转变为“违法性审查”。三是建强法律顾问队伍。出台《河南省政府法律顾问指导监督工作办法》,对律师、律师事务所担任法律顾问进行审查和备案。 五、健全行政执法工作体系,全面推进严格规范公正文明执法。一是深化行政执法体制改革。印发提升行政执法质量三年行动实施方案。指导15个省辖市对乡镇(街道)赋权事项进行逐一审查,形成“一市一清单”赋权模式。二是加强行政执法规范化建设。推行行政执法“四张清单”制度,确定不予处罚事项4649项、从轻处罚事项4742项、减轻处罚事项2136项、不予实施行政强制事项463项。公布实行告知承诺制的14155项行政事项,全年适用证明事项告知承诺制办理行政事项240万余件次,同比上升45%。三是深入推行服务型行政执法。命名80个“河南省服务型行政执法示范点”、40个“河南省服务型行政执法标兵”。出台行政许可到期提醒、不见面执法办案等13项具体举措,以“小切口”体现“大服务”。 六、健全突发事件应对体系,依法预防处置重大突发事件。一是完善突发事件应对制度。修订《河南省防汛应急预案》《河南省自然灾害救助应急预案》,指导各地修订总体应急预案48个、专项应急预案859个,进一步完善突发事件应对机制。二是提高突发事件依法处置能力。建立灾害事故应急快速响应机制,完善“先遣指导组、前方指挥所、基本指挥所”应急快速响应指挥体系。组织开展应急救援队伍“大练兵大比武”活动,组织各类演练7.8万余次、参加人员785.9万人(次)。三是增强基层应对突发风险能力。积极推动基层综合救援队伍建设,全省建有自然灾害类、安全生产类应急救援队伍5.6万支、101万人,其中县、乡、村级基层综合应急救援队伍达到5.5万支、91万人。 七、健全社会矛盾纠纷行政预防调处化解体系,不断促进社会和谐稳定。一是加强行政调解工作。积极开展行政调解“三个融入”试点工作,选取17个试点县(市、区)建立“五个一”行政调解组织保障工作体系。二是发挥行政复议化解行政争议主渠道作用。全省各级行政复议机关受理案件14065件、同比增加41.25%,法定期限内审结12651件(含上年结转案件345件)、法定期限内审结率为100%。通过调解、和解等方式化解结案3635件,化解率为28.7%,同比提高5.6个百分点。三是加强和规范行政应诉工作。定期对全省行政机关负责人出庭应诉情况进行通报,并将其纳入全面依法治省年度考核内容。在全省法院开庭审理涉行政机关的14715件案件中,行政机关负责人出庭应诉13381件,占开庭案件总数的90.93%。 八、健全行政权力制约和监督体系,促进行政权力规范透明运行。一是自觉接受监督。严格落实政府向本级人大及其常委会报告工作、接受询问和质询制度。组织办理全国人大代表建议29件、政协提案8件,分办督办省人大代表建议860件、政协提案950件,代表委员满意率和基本满意率为100%。二是强化审计监督。对1046名政府及相关部门主要负责人进行经济责任审计,实施审计项目5709个,促进增收节支和资金拨付到位784.83亿元,推动健全制度3628项。三是加强行政执法制约和监督。深入开展行政执法突出问题专项整治、道路交通安全和运输执法领域突出问题专项整治,查纠不作为、乱作为等执法问题13823个。组织开展行政诉讼发案量和败诉率“双下降”行动,行政败诉率同比下降7.99%。 九、健全法治政府建设科技保障体系,全面建设数字法治政府。一是加快推进信息化平台建设。启动省一体化政务服务平台和“豫事办”(二期)项目建设,“豫事办”注册用户数突破8412万,7195个事项实现“掌上办”。二是加快推进政务数据有序共享。印发政务服务事项“免证可办”工作方案,实现50类电子证照制发、175项事项“免证可办”。协调25个省直部门共享230项2971万条数据。三是深入推进“互联网+监管”建设。印发《河南省深入推进跨部门综合监管实施方案》,统筹各类监管资源数据联通汇聚,全省“互联网+监管”事项执法覆盖率达到86%。 2023年,我省法治政府建设虽然取得明显进展,但仍存在“关键少数”重视程度不够、基层政府重大行政决策程序意识不强、法治化营商环境需进一步优化等问题。2024年,我们将继续深入贯彻党中央、国务院关于法治政府建设的决策部署,认真贯彻落实习近平法治思想,进一步突出法治政府建设在法治河南建设中的重要地位,加快构建职责明确、依法行政的政府治理体系,为全面推进中国式现代化建设河南实践提供有力法治保障。
