(1)  2021年,在党中央、国务院及省委的正确领导下,在省人大及其常委会的监督指导下,全省各级政府坚持以习近平新时代中国特色社会主义思想为指导,认真贯彻落实习近平法治思想,把法治政府建设放在我省发展全局中统筹谋划,加快构建职责明确、依法行政的政府治理体系,全面建设职能科学、权责法定、执法严明、公开公正、智能高效、廉洁诚信、人民满意的法治政府,为经济社会发展提供了有力法治保障。 一、加强组织领导,完善法治政府建设推进机制。一是切实履行法治建设第一责任人职责。省政府主要负责人积极履行第一责任人职责,将建设法治政府摆在政府工作的重要位置,对法治建设重要工作亲自部署、重大问题亲自过问、重点环节亲自协调、重要任务亲自督办,严格落实学法制度,审定年度法治政府建设工作安排,切实把责任落到实处。二是完善“1211”法治政府建设推进机制。持续完善以“一平台、两抓手、一带动、一考核”为主体的法治政府建设推进机制,将依法行政考核升级为法治河南(法治政府)建设考核,考核对象由90个增加到104个。三是认真做好法治政府建设示范创建工作。推荐申报3个国家级法治政府建设示范地区和5个示范项目,开展10个省级法治政府建设综合示范地区和10个示范项目评选,表彰40个依法行政示范单位,树立了法治政府建设典型。 二、健全政府机构职能体系,推动更好发挥政府作用。一是做好行政许可事项取消和下放工作。公布2848项省政府部门权责清单目录。印发关于衔接落实国务院取消和下放一批行政许可事项的通知,取消行政许可事项16项,承接国务院下放事项3项,下放至省辖市政府、济源示范区管委会1项。按照“能放尽放”的原则,赋予县(市)255项省辖市级经济社会管理权限,进一步扩大县(市)经济社会发展自主权。二是全面推行证明事项告知承诺制和企业投资项目承诺制。印发《河南省省级证明事项告知承诺制清单》,160项省级、2016项市级、7769项县级证明事项实行告知承诺制。推行企业投资项目承诺制,将一般性企业投资项目开工前政府审批时间压减至40个工作日以内。三是开创“全豫通办”模式。构建全省政务服务事项统一受理体系,接入统一受理平台政务服务事项2285项,开设线下“全豫通办”窗口367个,首批800个政务服务事项实现全省通办,日均办件量超过2万件。全省“零跑动”和不见面审批事项比例达到93.56%。四是持续优化营商环境。开展全域营商环境评价,及时向社会公开评价结果,并将评价结果与年度目标考核绩效奖金、评先树优、领导班子和干部考核挂钩。 三、健全依法行政制度体系,加快推进政府治理规范化程序化法治化。一是完善政府立法体制机制。坚持党领导立法,省政府2021年度立法计划和重点立法项目均经省委常委会会议研究。进一步推行“1543”立法机制。二是以高质量立法保障高质量发展。坚持问题导向,加强重点领域立法,提请省人大常委会审议《河南省禁毒条例(修订草案)》等9部地方性法规,出台《河南省促进创业投资发展办法》等8部省政府规章,做到立法和改革相衔接、相促进。三是扎实开展行政规范性文件清理。组织开展涉及长江流域保护、优化营商环境、歧视性和不公平市场待遇政策措施的行政规范性文件清理工作,修改行政规范性文件44件、废止352件,切实维护法制统一。 四、健全行政决策制度体系,不断提升行政决策公信力和执行力。一是完善依法科学民主决策机制。制定《河南省重大行政决策程序规定》。成立省政府专家咨询委员会,遴选12名专家为第一批委员,对31个省级“十四五”专项规划开展集中审核。二是加大行政规范性文件合法性审核和备案审查力度。健全行政规范性文件合法性审核机制,出台的行政规范性文件全部经过合法性审核。省政府审查行政规范性文件501件,备案并公布468件,不予备案27件,纠正违法文件6件。三是推动法律顾问制度落实。组织省政府法律顾问对省政府重大涉法事务开展合法性论证35次,采纳意见建议200余条。2021年全省共有公职律师2960人,同比增长36%。 五、健全行政执法工作体系,全面推进严格规范公正文明执法。一是加强行政执法制约和监督。全面推行行政执法“三项制度”,推进行政执法事项标准化,对34个省级执法部门和17个设区市的1.3万余项执法事项进行审核确认并动态调整。二是全面落实行政执法责任制。公布47个省级行政执法主体,出台《河南省行政处罚听证办法》,建立轻微违法行为依法免予处罚清单。积极推进乡镇(街道)综合行政执法规范化建设,依法赋予济源示范区乡镇(街道)行政执法权。三是深入推进服务型行政执法建设。开展首届全省服务型行政执法比武活动,评选第二批30个“河南省服务型行政执法标兵”。 六、健全突发事件应对体系,依法预防处置重大突发事件。一是完善突发事件应对制度。出台事故灾难和自然灾害分级响应标准,修订完善突发事件总体应急预案,建立健全31项应急管理制度规范。二是提高突发事件依法处置能力。推动应急管理综合行政执法改革,推进县级应急管理综合执法队伍“局队合一”。开展应急资源普查等16项基础性工作,组织各类实战演练3万多场次。三是增强基层应对突发风险能力。出台关于加强基层应急管理体系和能力建设的意见,推动乡镇(街道)建立“1+4”(应急管理委员会和“应急办、应急救援队、物资储备库、县乡应急指挥平台”)应急体系,村(社区)建立“1+3”(安全劝导站和安全劝导员、灾害信息员、民兵应急救援队伍)应急体系。 七、健全社会矛盾纠纷行政预防调处化解体系,不断促进社会公平正义。一是探索建立行政调解告知引导制度。选取清丰县等7个县(市、区)作为试点,67个基层执法单位主动告知引导2283次,化解行政争议935件、民事纠纷11609件。二是强化行政复议和应诉工作。各级行政复议机关受理行政复议案件8340件,办结8409件(含上年结转),直接纠错率为16.9%。出台《河南省行政机关负责人出庭应诉工作规定》,各级行政机关负责人出庭应诉5508次,同比增长60.2%。三是健全多元化纠纷解决机制。全省建立各类人民调解组织5.56万个,排查化解矛盾纠纷58.92万件。 八、健全行政权力制约和监督体系,促进行政权力规范透明运行。一是自觉接受监督。严格落实政府向本级人大及其常委会报告工作、接受询问和质询制度,办理省人大代表建议852件和省政协委员提案1039件。全面推进政务公开,扎实推进政府信息公开平台建设,持续推进基层政务公开标准化规范化工作。二是加强政府督查。加强《政府工作报告》191项重点工作督查。认真办理国务院“互联网+督查”平台转交问题线索2800余件,核查办理重点问题线索58件。三是严格审计监督。对5818个单位实施审计调查,促进财政增收节支和挽回损失279.3亿元,促进资金拨付到位114.96亿元,向有关部门移送违规违纪违法线索701条,提出审计建议16117条,促进建立健全制度1686项。四是加快推进政务诚信建设。建立政务诚信监测机制,定期形成政务诚信月度、季度、年度监测报告。建立公务员录用、调任人选社会信用记录查询制度,累计查询328批次、14401人,对3人实施限制录用、调任措施。 九、健全法治政府建设科技保障体系,全面建设数字法治政府。一是打造“互联网+督导”新模式。推动法治河南(法治政府)建设督导平台省市联动运行,依托平台部署77项日常工作任务,落实年度督导任务5912项。二是构建“一网通享”新平台。49个省直部门梳理政务数据目录2334项、可调用数据量141.8亿条。完成国家电子证照跨省应用试点任务,制作电子证照324类、2.24亿张,实现电子居民身份证明、营业执照等高频电子证照跨业务应用。三是加强“互联网+监管”工作。接入12个国家部委的19个监管业务系统,汇集各类监管数据23.5亿条,提供数据查询服务11亿余次;汇集全省视频信号26万路,将348万户法人、801万余名特定自然人、38.5万套特种设备等纳入互联网平台监管范围。 2021年,我省法治政府建设虽然取得了一定成效,但仍存在一些薄弱环节,主要表现在:一些地方的基层法治队伍建设亟待加强,个别领导干部建设法治政府的使命感、紧迫感、责任感需要进一步增强,行政执法水平不高、效果不好的问题仍然存在等。2022年,全省各级政府将继续坚持以习近平新时代中国特色社会主义思想为指导,全面贯彻习近平法治思想,持续完善法治政府建设推进机制,奋力建设更高水平的法治河南,为谱写新时代中原更加出彩的绚丽篇章提供有力法治保障。
